Firm Wins Defense Verdict in Air Conditioning Contractor Liability Case

Senior trial attorney Mark A. Hruska won a defense verdict for our client, an air conditioning systems installer, B & L Air Conditioning, in Martin County after a five-day jury trial.  The case was brought by the home buyer who had a prior diagnosed lung condition which ultimately lead to a transplant some two years after he moved into his new home.  Plaintiff alleged that mold problems from claimed defects in the filtration system installed as part of the house construction aggravated his respiratory illness.  Co-defendant home builder was also found not at fault.  The trial involved multiple medical and other liability experts and was the second trial of the case, the first effort ending in a declared mistrial due to errors during direct examination of the plaintiff.  Plaintiff had claimed in excess of $1,000,000 in damages.  Post verdict motions for defense fees and costs are pending along with plaintiff's appeal of the jury verdict.
